PROBABLE CAUSE STATEMENT FORM

Date: November 3, 2009

1. I, Cynthia L. Schroer; knowing that false statements on this form are punishable by law, state that the facts contained herein are true.

I have probable cause to believe that, Burrell Edward Mohler, Sr: [censored] 1932; W/M [censored] - Listed Address: [censored] Independence, MO. Physical Identifiers: 5'09" - 180 lbs.

2. The facts supporting this belief are as follows:

The Lafayette County Sheriff's Department was contacted in August of 2009 by a Detective with the Independence Police Department with information of criminal activity perpetrated on children under the age of 12 at a location identified as [censored] Bates City, Missouri, Lafayette County. This property was purchased by Burrell Edward Mohler, Sr. on March 22, 1974. It was then purchased by his son, Burrell Edward Mohler, Jr. on July 19, 1995.

Burrell, Sr. fathered four sons identified as Burrell, Edward Mohler, Jr., Jared L. Mohler, Roland N. Mohler and David A. Mohler. Burrell Jr. fathered six children; five girls and one boy. The six children of Burrell Jr. have now approached authorities with information alleging abuse by all four sons of Burrell, Sr. as well as Burrell, Sr. himself.

On October 29, 2009, In interviewed [censored], age 26 who was identified as one of the victims in this matter. [Censored] is one of the female children of Burrell, Jr. and was born in 1983. She had suppressed many of the memories of abuse perpetrated on her as well as her siblings and is very fearful of her grandfather, father and uncles. During this interview, she identified 8 specific memories of abuse and a 9th that was perpetrated on her brother that she was forced to watch. The act perpetrated against her brother would also have been during the time listed below. She has many memories of abuse, but some of the abuse occurred in other jurisdictions in the State of Missouri as well as another State. [Censored] knows that all of these events took place prior to her turning 12 years of age and believes that most occurred from age 5 through 11 (March 1, 1988 through March 21, 1995. She became pregnant and was made to have an abortion at age 11 1/2. She doesn't remember any sexual abuse after that date. The abuse that occurred in Lafayette County specific to Burrel E. Mohler, Sr. is outlined below.

  1. Burrell E. Mohler, Sr. penetrated her vaginally with his penis. This was one of her first memories of the abuse that she and her sisters endured. She described the entire basement area where her grandfather's bedroom was located. This act occurred in his bedroom at the farm located at [censored] Old Concord Road, Bates City, Missouri, Lafayette County. After her grandmother died, when the girls would spend the night at the farm, they would rotate where they slept. One would sleep on the couch, another on a cot and they all took turns sleeping with their grandfather in his bed. On this occasion, [Victim 1] stated that her grandfather was in his boxers. She remembers being disgusted by his hairy chest and that his feet were cold. Burrell E. Mohler, Sr. "French kissed" her by placing his tongue in her mouth and then moved to lie on top of her. She began to feel as if she was suffocating as he penetrated her vagina with his penis.

  2. Burrell E. Mohler, Sr. penetrated her vaginally with his penis. This also occurred in the basement bedroom and [Victim 1] recalls that her other sisters were also in the room. [Victim 1] remembers that they were lined up on the bed lying on their backs. She was naked and Burrell Mohler, Sr. opened her legs with his hands and then lay on top of her. She again felt that suffocating feeling as he penetrated her vagina with his penis. This occurred at the farm at [censored] Old Concord Road, Lafayette County.

  3. Burrell E. Mohler, Sr. again was with [Victim 1] in his bedroom. He was lying with her on the bed. He had his penis between her legs moving his penis around. Then he said "oops, it slipped in". That is when he vaginally penetrated her vagina with his penis. This occurred at [censored] Old Concord Road, Lafayette County.

  4. When this next incident occurred, Jared Mohler, Burrell E. Mohler, Sr. and Burrell E. Mohler, Jr. were all in the room. They gathered several items that included a screw driver and a pencil. [Victim 1] and her sisters were lined up on the bed on their knees, facing away from their grandfather, father and uncle. [Victim 1] does not know which of the three specifically inserted the items into the anus of each girl. This occurred at [censored] Old Concord Road, Lafayette County.

  5. [Victim 1] recalls another incident where she was taken outside. Burrell Mohler, Sr., Burrell Mohler, Jr., Jared and Roland were all present. Her grandfather had a German Sheppard and she recalls that something had been tied around its mouth. She was placed on several pallets, laying on her back. The dog was then manipulated by these men to climb on top of her so that the dog could penetrate her with his penis. She remembers the discomfort and being very sore after this occurred. This occurred at [censored] Old Concord Road, Lafayette County.

PROBABLE CAUSE STATEMENT FORM

Date: November 3, 2009

I, Cynthia L. Schroer, knowing that false statements on this form are punishable by law, state that the facts contained herein are true.

1. I have probable cause to believe that, David A. Mohler; DOB: 08/12/57; W/M SSN: [censored] -- Listed Address: [Censored] S. Maple, Lamoni, Iowa. Physical Identifiers: 5'10" - 210 lbs.

2. The facts supporting this belief are as follows:

The Lafayette County Sheriff's Department was contacted in August of 2009 by a Detective with the Independence Police Department with information of criminal activity perpetrated on children under the age of 12 at a location identified as [censored] Old Concord Road, Bates City, Missouri, Lafayette County. This property was purchased by Burrell Edward Mohler, Sr. on March 22, 1974. It was then purchased by his son, Burrell Edward Mohler, Jr. on July 19, 1995.

Burrell, Sr. fathered four sons identified as Burrell, Edward Mohler, Jr. Jared L. Mohler, Roland N. Mohler and David A. Mohler. Burrell Jr. fathered six children; five girls and one boy. The six children of Burrell Jr. have now approached authorities with information alleging abuse by all four sons of Burrell, Sr. as well as Burrell, Sr. himself.

On October 29, 2009, I interviewed [Victim 1], age 26 who was identified as one of the victims in this matter. [Victim 1] is one of the female children of Burrell, Jr. and was born in 1983. She had suppressed many of the memories of abuse perpetrated on her as well as her siblings and is very fearful of her grandfather, father and uncles. During this interview, she identified 8 specific memories of abuse and a 9th that was perpetrated on her brother that she was forced to watch. The act perpetrated against her brother would also have been during the time frame listed below. She has many memories of abuse, but some of the abuse occurred in other jurisdictions in the State of Missouri as well as another State. [Victim 1} knows that all of these events took place prior to her turning 12 of age and believes that most occurred from age 5 through 11 (March 1, 1988 through March 21, 1995. She became pregnant and was made to have an abortion at age 11 1/2. She doesn't remember any sexual abuse after that date. Outlined below is the act of abuse that David Mohler perpetrated on [Victim 1] during the time frame that she would have been age 5 through 11 with the act most probably occurring when she was 7, 8 or 9. (years 1990, 1991, 1992).

  1. David Mohler was picked to "marry" [Victim 1] and a ceremony was conducted in the basement of the farm located at [censored] Old Concord Road, Lafayette County. [Victim 1] remembers that when these ceremonies would be held (there was more than); she and her sisters would pick flowers to adorn their hair. They also wore special dresses. After the ceremony where [Victim 1] was married to David Mohler, he walked her out to a travel camper that was parked in the yard at the farm. He told her that they would "become one person" and said "see, I go in you like this". That is when he penetrated her vagina with his penis.
